JUDGMENT No. 768 of 25 July 2012

for the modification and completion of the governmental decision nr. 1,372/2009 concerning the establishment, organization and functioning of the Institute for the investigation of Communist crimes and the memory of the Romanian exile

Pursuant to article 1. 108 of the Constitution of Romania, republished,

 

The Government of Romania adopts this decision.

 

Art. I

Government decision No. 1,372/2009 concerning the establishment, organization and functioning of the Institute for the investigation of Communist crimes and the memory of the Romanian exile, published in the Official Gazette of Romania, part I, no. 802 November 25, 2009, with subsequent amendments and additions, changes and shall be completed as follows:

  1. In article 1, paragraph (2) is amended and shall read as follows:

"(2) the Institute shall have its seat in Bucharest."

  1. In article 2, after paragraph d) insert a new drive letter, letter e) with the following contents:

"it's scientific investigation and identification) crimes, abuses and human rights violations throughout the period of the Communist regime in Romania, as well as referral to law enforcement agencies in those cases in which they are identified situations of violation of the law."

  1. In article 3 (1), subparagraphs (b)), n) and (q)) is amended and shall read as follows:

"b) gathers, documents and testimonies with regard to all actions which have violated human rights and freedoms in the Communist regime and on their basis the matter of criminal investigation bodies, regardless of the time and the circumstances in which they occurred;

  1. n) carrying out studies and research in the country and abroad, to deepen knowledge of the phenomenon of the Communist regime and the Romanian exile;

  1. q) editing and re-editing the finances, printing and publication of memoirs, books, studies, articles, correspondence, photographic memory and video, document collections, photographic albums; ".
  2. In article 3 (1), after the letter t) introduce two new letters, letters and exit) and u), with the following contents:

"rehabilitating the party activists), military, civilian employees and magistrates who had been working under the repressive apparatus of the party and State;

  1. u) identifies abuses and crimes committed, ordered or inspired by people who occupied the functions referred to in subparagraph (a). ţ). "
  2. In article 4, after the letter b) insert a new drive letter, letter b ^ 1), with the following contents:

"b ^ 1) studies, analyses, research, projects and programs in exercise, in partnership with public institutions, non-governmental organizations, professional associations and individuals in the country and abroad,".

  1. In article 4, subparagraph (d)) is amended and shall read as follows:

"d) initiation, establishment, development and support of collaborative and cooperative relationships with other units or departments of the Ministry of education, research, youth and sport, the Ministry of culture and national heritage, of the Romanian Parliament, Presidential Administration, Romanian Academy, national archives, with accredited universities in Romania and abroad, professional associations, as well as with other universities, institutes and research centers, local and international that have a subject of common interest; ".

  1. Article 4 ^ 1, paragraph (2) is amended and shall read as follows:

"(2) the Scientific Council shall meet whenever it is necessary and works on the principle of equality members. The Scientific Council is convened in the presence of at least half plus one of its members. "

  1. Article 4 ^ 1, after paragraph 6, insert a new paragraph, paragraph (7) with the following contents:

"(7) during the meeting of the Scientific Council, accommodation and transportation expenses may be covered by the budget of the Institute."

  1. In article 5, after (1) insert a new subparagraph (1 ^ 1), with the following contents:

"(1 ^ 1) Executive Chairman is employed and paid at the level of similar function the function of the dignity of the public institutions of Government."

  1. In article 5, paragraph 2, after you insert a new paragraph, (2 ^ 1), with the following contents:

' (2 ^ 1) Executive President shall adopt by order of expenditure requirements for specific activities of the Institute, with enrolment in the approved budget allocations and in compliance with the applicable legal provisions. These are subject to approval by the Chief authorising officer. "

  1. In article 5, paragraph (3) is amended and shall read as follows:

"(3) in its work, the Chairman of the Executive Board is assisted by a Steering Committee consisting of the Executive Director, the Executive Secretary and directors of departments."

  1. In article 5, paragraph (6) are repealed.
  2. In article 7, after paragraph 5, insert a new paragraph, paragraph (6) with the following contents:

"(6) the Institute may be delegated in accordance with the law, specialized personnel from the Public Ministry and the Ministry of administration and Interior."

Art. (II)

Government decision No. 1,372/2009 concerning the establishment, organization and functioning of the Institute for the investigation of Communist crimes and the memory of the Romanian exile, published in the Official Gazette of Romania, part I, no. 802 November 25, 2009, with subsequent amendments and additions, as well as those made by this judgment, will the Republic Official Gazette of Romania, part I, posing a new texts.
